Vendor’s Policy

At Stayhit, we are committed to providing our customers with a safe, reliable, and enjoyable online shopping experience. To ensure that all vendors who sell products on our platform adhere to legal and ethical practices, we have established the following Vendor Policy. Please read and understand these guidelines carefully as they govern your relationship with Stayhit when you sell products on our platform.

Seller Eligibility

The use of the Stayhit platform is available only to individuals and business entities that can legally form binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” as defined by the Indian Contract Act, 1872, including minors and un-discharged insolvents, are not eligible to use our platform. If you are under the age of 18, you may not register as a seller on our platform. Stayhit reserves the right to terminate your registration and deny access to the platform if we discover that you are under the age of 18. If you are registering as a business entity, you must have the proper authority to accept our Vendor Policy on behalf of the business entity.

Your Account and Registration Obligations

As a seller on Stayhit, you agree to provide accurate and up-to-date information as requested during the registration process. This information includes, but is not limited to:

  • Seller’s complete name
  • Seller’s complete address
  • Seller’s complete contact details
  • Seller’s Grievance Officer details for consumer complaints
  • Phone number
  • Email address
  • GSTIN (Goods and Services Tax Identification Number)
  • PAN (Permanent Account Number)
  • Business PAN
  • Pincode
  • Registered address (principal geographic address of headquarters and all branches)
  • Bank account details
  • Account holder name
  • Display legal name
  • Legal name/trade name
  • Total price in a single figure of any goods/services (breakup price/charges, if any)
  • Relevant details of goods, including manufacturer/packer name and complete address
  • Relevant details of imported goods, including importer name and country of origin
  • Relevant guarantees or warranties applicable to all goods/services you sell on the platform

You are responsible for maintaining the confidentiality of this information, as well as your display name, login, and password details. Providing false, inaccurate, or incomplete information, or violating our Vendor Policy, may result in the suspension or termination of your account on the platform.

Seller Account Deactivation

If a seller requests the closure of their account, we will place the account on hold for 90 days to facilitate the closure of any pending transactions. During this period, the seller can download payment and taxation reports, if necessary. After 90 days, the seller must confirm the download of reports and request account deactivation again. Once we receive this confirmation and verify there are no outstanding payments, we will deactivate the seller’s account. Certain information, such as the registered mobile number, registered email ID, GSTIN, and transaction-related information, will be retained for auditing and fraud prevention purposes. If a seller wishes to resume business with Stayhit, they may not create a new account, but their older account can be restored if required.

Communications

When using the Stayhit platform or communicating with us via email or other means, you consent to receive electronic communications from us. We may contact you via email or other electronic methods for various purposes, including notifications, updates, and support.

Platform for Transaction and Communication

Stayhit provides a platform for users to independently meet and interact for their transactions. We do not participate in or mediate transactions or disputes between users on the platform. Therefore:

  • All commercial and contractual terms, including price, payment methods, delivery terms, and warranties, are agreed upon solely between you and the buyer.
  • Stayhit does not make any representations or warranties about the quality, value, or saleability of products or services listed on the platform.
  • We are not responsible for any non-performance or breaches of contracts between you and buyers.
  • Stayhit does not vouch for the identity or trustworthiness of users and advises independent verification of buyers’ bona fides.
  • We do not hold any rights or interest in the items you sell or have any obligations or liabilities related to such contracts.
  • Stayhit is not responsible for unsatisfactory or delayed services, damages, or other issues arising from items that are out of stock, unavailable, or back-ordered.

Use of the Platform

Your use of the Stayhit platform must adhere to the following principles:

  • Do not host, display, upload, modify, publish, transmit, or share any information or images that belong to others without the right to do so.
  • Do not engage in harmful, harassing, defamatory, obscene, or illegal activities on the platform.
  • Provide accurate and truthful information.
  • Do not harass or advocate harassment of others.
  • Do not engage in spamming or unsolicited mass mailing.
  • Do not promote illegal activities or abusive conduct.
  • Respect intellectual property rights and do not infringe on third-party rights.
  • Do not engage in unauthorized access or exceed authorized access to the platform.
  • Do not interfere with the proper functioning of the platform or attempt to hack it.
  • Do not impersonate others or use false identities.
  • Do not use the platform for unlawful purposes or to solicit illegal activities.
  • Grant Stayhit the right to use the information you provide for promotional and business purposes.

Vendor Acceptance

By registering as a vendor on the Stayhit platform, you acknowledge that you have read, understood, and accepted our Vendor Policy.

Modification

Stayhit reserves the right to modify this Vendor Policy at any time without prior notice. It is your responsibility to stay informed about any changes to these policies.

Copyright Infringements

Vendors on Stayhit must ensure that the products they list do not infringe on any copyrights. Products found in violation of copyright laws will be removed, and legal action may be taken.

Trademark

Vendors must have the legal rights to sell products featuring trademarks or logos. Infringing on trademarks of others or using similar trademarks without authorization is prohibited.

Ethics

Vendors must adhere to ethical business practices, refrain from deceptive or fraudulent practices, and accurately represent their products.

Illegal Products

Selling illegal products on Stayhit is strictly prohibited, and vendors found doing so will be removed from the platform.

Returns

Vendors must accept returns for valid customer complaints, ensuring a fair customer experience.

Misuse of Platform

Vendors must not engage in fraudulent, deceptive, or illegal activities on the Stayhit platform that could harm our reputation, customers, or operations.

This Vendor Policy, including its annexures, constitutes the entire agreement between you and Stayhit and supersedes all other agreements related to the subject matter. Stayhit reserves the right to modify this policy as needed.
